SANA'A March 31. 2024 (Saba) - The judiciary achieved 709,676 judicial achievements, by deciding cases received by the courts, during the past nine years of aggression.

The number of incoming cases reached 758,068 cases, in addition to 85,380 cases carried over from years prior to the aggression, bringing the total pending cases during that period to 843,448 cases, with a completion rate of more than 84 percent.

This statistic reflects the level of steadfastness enjoyed by members of the judiciary in performing their duty, despite the bombing that targeted their workplaces and homes, and the martyrdom of some of them and their families, it also clear evidence of good management and the development of work mechanisms in the various sectors, departments of the Judicial Council Supreme and the Supreme Court.

According to the numbers and information that were reviewed in the press conference of the judiciary, on the ninth anniversary of the National Day of Resilience, by the Minister of Justice, there practical and effective action by the judiciary’s organs, in accordance with the annual plans and directives of the Leader of the Revolution and the President of the Supreme Political Council.

The Judicial Council addressed many of the problems facing the judiciary, most notably filling vacancies, promotions, and raising the efficiency of judicial work, by issuing many transfer decisions and partial judicial movement, as well as assigning 88 judges and prosecutors to the inspection authority in the court and prosecution sectors.

The Council’s decisions included the appointment of 522 graduates of the Higher Judicial Institute for the “18, 19, 20, 21, and 22” batches, distributing them to a number of courts and prosecutors of first instance, and appointing 283 prosecutors from graduates of the Continuing Rehabilitation Department - first batch, “Criminal Sciences,” from The Higher Institute of the Judiciary, and their distribution to the prosecution offices at the end of the year 1443 AH.

In addition to the admission of 296 students to the Higher Institute of the Judiciary for the two batches “23, 24” in the Department of Specialized Studies for a period of three years, and they still continuing their studies, at the institute, and through practical application in the field in courts and prosecution offices.

The Council agreed - as part of its work to follow up on the work of the judiciary and lift judicial inspection - to file 107 disciplinary lawsuits against judges, 13 lawsuits against prosecutors, refer 116 judges and prosecutors to accountability, and issue 102 disciplinary rulings against 102 judges and prosecutors, and 58 judges and prosecutors were dismissed of judicial work.

The Supreme Judicial Council decided on approximately 970 grievances and requests from some members of the judiciary, related to settlements, transfers, efficiency assessments, etc. In 2018, it issued decisions to promote 2,487 judges and prosecutors, and agreed to settle the job grades of employees of the judiciary in accordance with the Civil Service Law for about Eight thousand and 600 employees.

During the steadfastness period, the Council approved the establishment of one court of appeal, 21 appellate divisions, 16 courts of first instance, one prosecution office, and 17 prosecution offices of first instance.

In the field of qualification, training and capacity development of members of the judiciary, 330 specialized courses were organized, targeting no less than 11,913 trainees from the judicial and administrative staff and judicial police officers.

Regarding the work and projects of judicial automation and networking, a joint committee was established to develop and unify the judiciary’s information centers.

In the cases of prisoners and prisons, inventorying, investigating, and confronting the crimes of aggression, the Council dealt seriously with the heinous and ongoing crimes committed by the aggression, as it issued directives to inventory and investigate crimes, and prepare judicial files.

The statistics issued by the press conference showed the damage caused to the judiciary in its buildings and facilities as a result of the aggression, and the martyrdom of many judges and administrators, as the number of courts that were completely or partially damaged reached 49 courts, and the total financial cost necessary to reconstruct the judicial facilities that were targeted by the aggression, amounted to one hundred million dollars without compensation.

The Supreme Court also moving in the same direction to keep pace with developments and achieve the justice that the citizen aspires to. During the period from 1436 AH to the first half of the year 1445 AH, it received 28 thousand and 124 appeals and petitions. It was able, in its various departments, to complete 18 thousand and 834 appeals and petitions. .

According to what stated in the judicial authority’s achievement report, the court issued 27 judicial circulars and circulars with the aim of unifying legal procedures in all courts and interpreting some ambiguous legal texts.

The Supreme Court kept pace with developments in the field of modern technology in its work by electronic printing and converting paper rulings and decisions issued by its bodies and departments into electronic files in PDF format for 84,923 cases until the end of the year 2018 AD, and producing CDs with the rulings issued for each judicial year, in order to benefit from them in Judicial research.

The court seeks to electronically archive all its previous rulings with judgment records, amounting to 207,282 cases, and to manually archive 2,250 judgments with judgment records to prepare them for electronic archiving in the coming period.

The Supreme Court contributed to spreading judicial and legal awareness by issuing nine books of judicial rules (civil and criminal), printing two thousand copies of each book, as well as issuing a book of all constitutional rulings and cases issued by the Constitutional Chamber of the Supreme Court until 2015 AD.

The court is currently preparing to issue four other books of judicial rules, which were extracted from rulings and decisions in civil and criminal cases, as well as issuing a special book on administrative cases.

At the same time, the Technical Office of the Supreme Court studied 901 rulings received from the chambers and extracted 70 judicial rules from them, which are in the process of being prepared to be published in booklets.

The press conference touched on what the Supreme Court provides through “public service” by establishing a hotline number “230550/01” to receive citizens’ complaints and inquiries, and appointing a number of employees to communicate directly with citizens to answer their inquiries.

- Judicial Inspection Authority

The Judicial Inspection Authority is considered one of the most important bodies in the judiciary that monitors performance, and it was able - during the years of aggression - to advance the pace of work in the courts, which improves every year, compared to the increasing volume of incoming cases annually, as the total number of cases incoming to the courts reached 758 thousand and 68 cases.

The Authority also counted the stalled cases before the courts, which amounted to 25,000 cases, and urged the courts to complete them, as the number of completed cases reached 17,833 cases, with a completion rate of 72 percent, in addition to implementing several surprise inspection sessions on judges.

The Commission created an “Inspector Designation Program” for every 15 judges, and the program was implemented in the capital, Sana’a, and in Sana’a Governorate, during the years 2020 AD and 2021 AD as a first stage, and then the second stage was launched at the end of the year 2021 AD, with the formation of committees to continuously inspect the courts in the rest of the governorates.

The Commission’s work included, after studying the courts’ needs for judges, the distribution of new graduates of the Higher Judicial Institute after spending a training period in the Public Prosecution, where 458 judges were distributed, and more than 26 judges from the newly graduated “22” batch are currently being trained in preparation for their distribution to the courts, after they receive adequate training.

In the field of training and qualification, the Authority established a special department for training judges and administrative cadres, and was able to prepare training programs, some of which were implemented.

Since the establishment of the Training Department, courses have been held to cover the training needs that the Authority senses from the fact that its inspectors go to the field, it organized 24 short training courses, targeting 443 judges and employees of the Authority.

During the past years, the Commission was able to deal with large numbers of complaints, as a result of which more than 278 complaints were referred for investigation, and more than 100 disciplinary cases were filed against the complained judges.

Regarding the implementation of the national vision initiatives, the Authority completed 16 activities assigned to it, it also analyzed the current situation and identified priorities that exceeded 25 priorities.

- Ministry of Justice

The Ministry of Justice achieved qualitative achievements during the period of aggression. In the field of national vision, the Ministry’s Executive Unit for Vision implemented many works, the most important of which is preparing the matrix of the executive plan for the year 2021 AD, within the plan of the judicial authority, and preparing and issuing cards for initiatives and projects for the phased plan for the year “2021 AD - 2025 AD.”

The Ministry participated in the training courses, which were held by the Executive Office of the National Vision Department, related to the planning process and preparation of plans, during the past two years, participating in the participatory planning process within the Justice and Rule of Law axis work team, and preparing quarterly evaluation reports on the implementation of the National Vision Plan for the year 2021 AD.

The work carried out by the Ministry, including draft executive plans for the national vision for building the state, included the preparation of a draft law regulating the work of expertise and experts, a draft regulation for the judicial printing press, and a draft financial regulation for the Higher Judicial Institute.

The Ministry is implementing the projects and activities included in the plan, in accordance with the specified commitment, which numbered 12 projects, some of which are completed and some are under implementation.

In the field of networking, 202 courts were linked, including 23 courts and appellate divisions, and 179 courts of first instance, and the number of case sessions entered electronically into the judicial system was three million and 109 thousand and 492 sessions linked to 712 thousand and 199 cases.

During the year 1445 AH, the Ministry installed the fingerprint system in 25 courts in Sana’a, and the Sana’a and Hodeidah governorates as a first stage.

In the field of documentation and trustees, the Ministry of Justice approved at least 31,347 official documents and documents by the General Administration of Documentation, and granted 1,86 licenses to legal trustees in the Republic.

Three million, 339,316 documents were also approved during the nine years, represented by one million, 759,793 documents in the general courts of first instance, 101,683 documents in the commercial courts of first instance, and 200,898 documents in the traffic courts of first instance.

In the field of training and qualification, the Ministry of Justice implemented 94 training courses in various administrative, financial, technical, technical and documentation fields, benefiting three thousand and 927 trainees, including 929 judges and employees, who were trained to use the judicial system, Including 62 judges from the Judicial inspection Authority, 209 employees were trained on the transaction system, in addition to implementing 45 workshops in which 1,679 trainees participated.

In the field of complaints, the Ministry received 21,000 complaints and inquiries through the Public Administration, the Operations Room, and the Hotline, including 18,500 complaints and inquiries through the Operations Room and the Hotline, and all of its were dealt.

With regard to the protection of children and disadvantaged women, the Ministry of Justice contracted with 31 lawyers and 30 social experts during the nine years.

In investigation, discipline and anti-corruption, 431 administrative employees were referred for investigation and discipline, 167 of them were tried, and disciplinary penalties were imposed on 90 violators.

The Ministry of Justice issued 97 issues of the Judicial Gazette, including 22 special issues, distributing no less than 734,000 paper copies, in addition to publishing it electronically, and launching the Judicial Gazette’s electronic website.

Likewise, the “Your Legal Advisor” website was created and launched, in addition to preparing, issuing and printing three books on uncovering and exposing crimes of aggression, and distributing four thousand copies of them.

The crimes of the aggression coalition against the buildings of the judicial authority were also documented and published through various judicial media outlets.

In the field of international cooperation, the Ministry of Justice compiled and printed the book “International and Domestic Agreements”, which our country ratified, and sent four agreements to the House of Representatives for the purpose of approval.

The Ministry printed and provided many items and publications through the judicial printing press, with a total of 427 thousand and 988 copies, worth 561 million and 111 thousand and 550 riyals.

In the field of revenues, the Ministry and various courts provided the state treasury, during the nine years of aggression, with central, local and private revenues in the amount of 16 billion, 570 million, 267 thousand and 220 riyals.

- Public Prosecution

During the years of aggression, the prosecution witnessed many achievements, whether in the field of cases, recovering public money, or related to prisoner affairs, as the total number of cases received by the prosecution of various types, the prosecution of appeals, the prosecution of cassation, and the technical office, from 2015 AD until the first half of Year 1445 AH, 528 thousand and 694 cases.

The number of cases received by the prosecution of first instance reached 377,976 cases, of which 324,943 cases were disposed of, with a completion rate of 86 percent, the number of cases received by the prosecution prosecution reached 131,453 cases, of which 127,033 cases were disposed of, with a completion rate, it reached 97 percent.

The total number of cases received by the Cassation Prosecution amounted to six thousand and 742 cases, which were disposed of with a completion rate of one hundred percent, while the total number of cases received by the Technical Office reached 12 thousand and 523 cases, 12 thousand and 510 cases were disposed of, with a completion rate of 99.9 percent.

The number of judges who were transferred and assigned as members of the prosecution reached 1,405, while the number of complaints received by the Judicial Inspection in the Public Prosecutor’s Office reached 7,406 complaints received, while the complaints stored were 2,834 complaints, and the ones disposed of and referred to the prosecution offices were 4,405, complaints, which referred to the Judicial Council: 23 complaints.

27 prosecutors were inspected by 177 inspection committees, of which 32 committees carried out periodic inspections, targeting 430 prosecutors, while the number of surprise inspection committees reached 145 committees, targeting 239 members.

The total number of prosecutors inspected administratively and financially reached 230, and the inspection revealed 72 administrative violations and 136 financial violations.

- Crimes of aggression

The number of reports registered for incidents of crimes of aggression with the prosecution reached seven thousand and 886 reports, and according to the latest report issued by the Office of the Public Prosecutor, in the year 1443 AH, the number of crimes that were investigated reached five thousand and 451 crimes, and four thousand and 179 crimes.

The number of reports regarding bombing incidents reached seven thousand and 324, and the number of reported deaths reached 17 thousand and 144 and the wounded 26 thousand and 475, 403 monitoring incidents were also monitored, and one thousand and 500 cases were registered.

In the field of electronic automation, 157 prosecutions were linked to the criminal case process system, and 270,60 cases were registered electronically.

In protecting public funds, public funds prosecutors at various levels were able to follow up on the movement of case files, until judicial rulings were issued to recover or confiscate them.

The total amounts and real estate assets recovered to the public treasury and the account of government agencies, pursuant to judicial rulings and seizure orders, amounted to 36 billion, 43 million, 436 thousand and 995 Yemeni riyals, and 79 million, 588 thousand and 346 dollars.

In the field of training and qualification, the Training and Qualification Department in the Attorney General’s Office held 250 courses and workshops, from which five thousand and 966 judges, prosecutors, judicial officers, and administrative employees benefited.

The Forensic Medicine Department in the Public Prosecutor’s Office was able to accomplish all the tasks entrusted to it by the courts and prosecution offices, including medical examination and scrutiny of the ambiguous causes of criminal crimes, and the reports issued by it in this regard amounted to 23,248 medical decisions.

Regarding prisons and prisoners, the statistics showed that the prosecution, during the years of aggression, released 59,354 prisoners with guarantees, 34,262 prisoners after the sentence was executed, and 6,219 prisoners were released.
