Parliament approves draft law to add article related to criminalization of insulting prophets and messengers

SANA'A May 13. 2024 (Saba) - The House of Representatives approved in its session on Monday, under the chairmanship of the Speaker of the Council, Brother Yahya Ali Al-Ra'i, a draft law for the year 2020 AD to add an article to the Republican Decree by Law No. 12 of 1994 on crimes and penalties, in light of the report of the joint committee of the committees codifying the provisions of Islamic Sharia and justice and endowments.

Article 259 stipulates:

(a) Whoever despises or offends one of the prophets and messengers in word or deed by any means whatsoever, after ascertaining the same, shall be punished by imprisonment for a term not exceeding five years.

(B) Without prejudice to the liability of the natural person, the legal person in whose name, by, for his benefit or for his account the crime stipulated in the preceding paragraph was committed shall be punished by a fine of not less than 10 million riyals, and the court may, in the event of return, order the suspension of the activity of the legal person for a period not exceeding one year.

(C) The person responsible for the actual management of the legal person shall be punished by the same penalty prescribed for the crime in paragraph (a) of this Article if the crime is committed in the name and for the benefit of the legal person by one of its employees when it is proven that the official knew or consented thereto.

The Council also approved the Committee's recommendation to add jurisdiction to the Yemeni courts with regard to the provisions of Article 294 of the Code of Criminal Procedure.
