Public Prosecution completes more than 27 thousand cases

SANA'A March 15. 2024 (Saba) - Indicators of judicial work and the activity of the Public Prosecution Office, based on the criminal case process system, for the first half of the Hijri year 1445 AH, showed an increase in the level of completion of cases received by the appellate prosecution offices by 94 percent, and of the first instance prosecution offices by 76 percent.

These results constitute clear evidence of the effectiveness of the current Public Prosecutor’s management of human and material capabilities, as expertise was invested and focus was placed on continuous development plans within the framework of the Public Prosecution’s strategic projects, which have become a sound approach to correct the procedural path, consolidate institutional work, and accomplish the tasks represented in strengthening the rule of law, justice, and community protection, with outstanding performance.

According to the indicators, the activity of the appeals prosecution offices was full of achievements, on various tracks with regard to studies of cases referred to them by the prosecution offices of first instance, during the first half of the year 1445 AH, which amounted to 13,261 studies, 12,485 studies were disposed of, with a completion rate of 94 percent.

These numbers reflect the good management of the Public Prosecutor, Judge Dr. Muhammad Al-Dailami, and his appointment of his agents in the field, which matched by the steadfastness, dedication and sincerity of the heads of the prosecution in their work, which is not limited to the judicial side only, but there are more important tasks related to monitoring and evaluating the performance of the primary prosecution offices affiliated with them, hese actions are based on important rules for their completion, the most important of which are experience, competence, and integrity, as well as leadership and administrative capabilities, which the recent training programs, implemented by the Attorney General’s Office, played a major role in strengthening.

This administration had fruitful results, which were reflected in the field reality, which enabled the primary prosecution offices to complete the disposition of 27,150 cases, out of a total of 35,535 cases received by them, during the first half of 1445 AH, with a completion rate of 76 percent, compared to the year 444 AH, which amounted to 67 percent.

In this context, the judicial inspection in the Public Prosecutor’s Office had a remarkable presence and an important role during the first half of the year 1445 AH, through the implementation of the Public Prosecution’s plan approved by the Supreme Judicial Council related to the periodic inspection work that was suspended in 2014 AD, as it targeted 35 judicial committees 431 A prosecutor to evaluate their work, and know the level of their professional performance from the reality of it's work in the primary and appellate prosecution offices in Sana’a, and the rest of the governorates in three stages.

Where 16 judicial committees carried out a surprise inspection of the work of the first instance and appellate prosecution offices, monitored any violations, corrected some procedures that violated the law, and solved any problems or obstacles that impeded the progress of judicial work, and delayed citizens’ access to their right to obtain justice, and this resulted in the completion of 6 thousand 128 A case, one of the late cases, was disposed of in accordance with the law.

The judicial inspection also received 600 complaints, 493 acted upon, by referring 218 complaints to chief prosecutors; to correct the procedures, three warnings and seven observations were issued to members of the Public Prosecution, and 265 complaints were filed, while the remaining 107 complaints under consideration and follow-up.

At the same level, during the first half of the year 1445, the technical office in the Public Prosecutor’s Office carefully examining the judicial files submitted to it by necessity, or referred to it for study and expressing an opinion, for a number of 2,032 cases, as 943 cases received by the Review Division, and 1,042 cases received to the Case Examination Division, 37 cases received by the Complaints and Investigations Division, and ten cases were received by the International Cooperation and Human Rights Division, all of these cases disposed of with a 100% completion rate.

Within the framework of the tasks assigned to the Public Prosecution related to studying and evaluating crimes based on the criminal cases received, the criminal case system has classified crimes in terms of occurrence, specifically the ten highest crimes in terms of occurrence, which what state institutions and agencies concerned with security, society, education, and guidance must do, opening broader opportunities with the prosecution regarding adopting programs aimed at addressing its.

The crime of intentional harm topped the list nationwide with four thousand and 506 cases, followed by non-punishmental theft with three thousand and 992 cases, and in third place assault on the sanctity of another’s property without an aggravating circumstance with two thousand and 463 cases, breach of trust with 1,811, threats with 1,781, and fraud 1,593, violation of a law 1,427, health violation is 983, wrongful injury 945, harm to property is not serious, 841, and the rest of the crimes 15,262 cases.
